Can I Bring my Spouse with me if I am Studying or Working in Canada?

The short answer is yes, however your personal circumstances as the temporary resident in Canada would dictate what capacity your spouse could join you in.

If you are a student in Canada, your spouse or common-law partner can join you on an open work permit only if you are studying a Masters or a PhD program. However if you are studying for an undergraduate degree, a diploma or certificate, your spouse would not be able to come and work in Canada, instead they would only be able to accompany you as a visitor.

If you hold a work permit in Canada, whether this is a post-graduate work permit or a closed work permit, your spouse would be able to apply for an open work permit to join you, allowing them to work for any employer in Canada, without the need for a prior job offer or an LMIA, for the same duration as your work permit.

If your spouse or common-law partner is not eligible to join you with an open work permit, there may still be options, such as switching study programs to a Masters, applying for a permanent residence program, obtaining a job offer independently, or working remotely in Canada.
